Please read these Terms of Use (“Terms”) carefully before using ViviApp.

1. Acceptance of the Terms

By accessing or using ViviApp (our website or mobile application), you agree to be bound by these Terms. If you do not agree, you must not use ViviApp.

2. Who we are

ViviApp is a platform that connects clients with wellness and service providers. Our base of operations is in Costa Rica.

3. Eligibility

• You must be at least 18 years old to create an account and use ViviApp as a client or provider.
• You agree that all registration information you submit is truthful, accurate and up to date.
• You are responsible for complying with local laws applicable to your use of the platform and services.

4. Description of the service

ViviApp provides a digital platform that allows:

• Clients to discover providers and services.
• Providers to create and manage profiles, services, availability and schedule blocks.
• In future versions: booking flows, reminders, and other features around appointments.

ViviApp is not a healthcare provider, clinic, or employer of the providers. Providers act as independent professionals, responsible for their own services, qualifications, and compliance with applicable law.

5. Accounts, security and responsibilities

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activities that occur under your account.
• You agree to notify us immediately at support@viviapp.co if you suspect any unauthorized use of your account.
• We may suspend or terminate accounts that violate these Terms or applicable laws.

6. Role of ViviApp

ViviApp acts as a technology platform that facilitates the connection between clients and providers. We do not supervise, control or guarantee:

• the quality, safety or legality of services offered by providers;
• the truthfulness or completeness of provider profiles; or
• the outcome or results of any service you receive.

Any relationship or agreement for services is directly between the client and the provider.

7. Bookings and payments

Booking features and in-app payments may be gradually implemented. When they are active in your region, additional terms or policies (for example, cancellation policies, fees, or payment processing terms) may apply.

Providers are responsible for setting their prices, durations, and cancellation rules, as well as for complying with tax and invoicing requirements in their jurisdiction.

8. Provider responsibilities

If you use ViviApp as a provider, you agree to:

• Provide accurate and truthful information in your profile and service descriptions.
• Offer services only if you have the required qualifications, certifications, or licenses under applicable law.
• Keep your availability and schedule blocks reasonably up to date to avoid unnecessary cancellations or rescheduling.
• Respect clients’ privacy and comply with data protection laws when handling their personal information.

9. Client responsibilities

If you use ViviApp as a client, you agree to:

• Provide truthful and accurate information during registration and booking.
• Show up on time for booked services, or cancel/rebook according to the provider’s policies.
• Treat providers with respect and follow reasonable instructions related to the service.

10. Acceptable use

You agree not to:

• Use ViviApp for illegal purposes or in violation of any law or regulation.
• Harass, threaten or harm other users.
• Upload or share content that is offensive, discriminatory, defamatory, or harmful.
• Attempt to access data or systems without authorization, or interfere with the operation of the platform.
• Use bots, scrapers or similar tools to extract data without our express written permission.

11. Intellectual property

• The ViviApp brand, logo, design, and all related intellectual property belong to us or our licensors.
• Service descriptions, photos and profile information provided by providers remain their own content, but by uploading them to ViviApp, providers grant us a license to display such content on the platform for the purpose of operating the service.

12. Third-party services and links

ViviApp may contain links or integrations with third-party services (such as email providers, payment processors, or analytics tools). We are not responsible for the content, policies or practices of these third parties. We encourage you to review their terms and privacy policies.

13. Disclaimers

ViviApp is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the platform will be uninterrupted, secure, or free of errors, nor do we guarantee any particular result from the use of ViviApp or from services booked through the platform.

14. Limitation of liability

To the maximum extent permitted by law, ViviApp and its founders, employees, and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, or goodwill, arising from:

• your use or inability to use the platform;
• any conduct or content of other users or third parties; or
• any services you receive from providers found through ViviApp.

Where our liability cannot be fully excluded, it will be limited to the maximum extent allowed by applicable law.

15. Indemnification

You agree to indemnify and hold ViviApp harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of: (a) your use of the platform; (b) your violation of these Terms; or (c) your violation of any third-party rights.

16. Termination

We may suspend or terminate your access to ViviApp at any time, with or without notice, if we reasonably believe that you have violated these Terms, misused the platform, or engaged in unlawful activities.

You may also stop using ViviApp at any time and request the deletion of your account by contacting support@viviapp.co.

17. Governing law and jurisdiction

These Terms are governed by the laws of Costa Rica, without regard to its conflict of law rules. Any disputes arising out of or relating to these Terms or your use of ViviApp shall be submitted to the competent courts of Costa Rica, unless mandatory law provides otherwise.

18. Changes to these Terms

We may modify these Terms from time to time. When we do, we will update the “Last updated” date at the top and, where appropriate, notify you through the app or by email. Your continued use of ViviApp after the changes become effective constitutes your acceptance of the new Terms.
